Please read these Terms of Service (“Terms”) carefully. They govern your access to and use of our website, https://bcra.academy (the “Site”), along with any related services, forms, placement assessments, and communications offered by Black Children Reading Academy (“BCRA,” “the Academy,” “we,” “us,” or “our”).

By using the Site or submitting information to us, you agree to be bound by these Terms.

1. Who We Are

Black Children Reading Academy is an independent foundational literacy program located in Sacramento, California, serving students in grades 1 through 4. The Academy provides structured, small-group reading instruction grounded in the Science of Reading, along with take-home practice materials and a family-partnership model.

BCRA is an independent educational program and is not affiliated with, endorsed by, or acting on behalf of any public or private school district.

2. Eligibility and Who May Use This Site

The Site is directed to parents and legal guardians, not to children.

You must be at least 18 years old to submit information through the Site or enroll a child in the program.

If you submit information about a child, you represent and warrant that you are the child’s parent or legal guardian, or that you are otherwise legally authorized to provide that information and consent to these Terms on the child’s behalf.

Children should not use the Site directly or submit personal information themselves. All information regarding a prospective or enrolled student must be provided by a parent or legal guardian.

3. Placement Assessment and Enrollment

  • BCRA offers a complimentary placement assessment to determine a prospective student’s reading level and program fit.
  • Completing the placement assessment does not guarantee enrollment. Enrollment depends on the availability of an appropriate reading-level cohort, program capacity, and family readiness to participate.
  • Instruction is delivered in small cohorts grouped by reading level. Because cohorts are formed as sufficient numbers of students at comparable reading levels become available, there may be a waiting list or waiting period before an appropriate cohort is formed.
  • Active family participation—including reinforcing take-home practice between sessions—is a condition of enrollment. The Academy’s instructional model depends on a partnership among the instructor, student, and family.

4. Fees and Payment

Program fees, schedules, and applicable payment terms will be communicated during the enrollment process.

Where payments are processed through the Site or a third-party payment processor, you agree to provide accurate billing information and authorize all applicable charges.

Any refund, cancellation, or withdrawal policies will be provided as part of your enrollment agreement. That agreement, together with these Terms, governs your relationship with the Academy.

5. Acceptable Use

When using the Site, you agree that you will not:

  • Submit false, misleading, or unauthorized information, including information about a child you are not authorized to provide.
  • Use the Site or its content for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the Site, its servers, or related systems or data.
  • Interfere with or disrupt the operation of the Site or introduce viruses, malware, or other harmful code.
  • Copy, reproduce, distribute, modify, or commercially exploit the Academy’s content, curriculum descriptions, instructional materials, or other intellectual property except as expressly authorized in writing.

6. Intellectual Property

The Site and all of its contents—including text, graphics, logos, the BCRA name and brand, curriculum descriptions, instructional materials, videos, and take-home practice materials—are owned by or licensed to Black Children Reading Academy and are protected by applicable intellectual property laws.

Instructional and take-home materials are provided solely for the educational use of enrolled families and their child. They may not be copied, redistributed, resold, published, or used for any commercial purpose without our prior written permission.

7. Take-Home Materials and Family Responsibilities

Families receive instructional materials intended to reinforce learning between sessions.

Parents and legal guardians are responsible for supporting their child’s use of these materials and completing any practice or review activities requested by the Academy.

Student success depends upon this shared partnership between the Academy, the student, and the family. Accordingly, the Academy does not guarantee any particular educational outcome.

8. No Guarantee of Results

The Academy is committed to providing effective, evidence-based reading instruction grounded in the Science of Reading.

However, every child learns at a different pace, and many factors influence educational progress.

Accordingly, BCRA does not guarantee any particular reading level, academic grade, standardized test score, educational outcome, or timeline for improvement.

Statistics, research findings, or educational studies referenced by the Academy describe general associations and are provided solely for informational purposes.

9. Third-Party Links and Services

The Site may contain links to third-party websites or use third-party services, including scheduling platforms, forms, payment processors, analytics providers, and customer relationship management (CRM) systems.

We are not responsible for the content, privacy practices, or policies of any third party. Your use of those services is governed by their respective terms and privacy policies.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL OPERATE WITHOUT INTERRUPTION, WILL BE SECURE, OR WILL BE FREE OF ERRORS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLACK CHILDREN READING ACADEMY, ITS OWNERS, EMPLOYEES, CONTRACTORS, INSTRUCTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING ANY LOSS OF DATA, BUSINESS INTERRUPTION, OR LOST PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR PARTICIPATION IN THE PROGRAM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Black Children Reading Academy and its owners, employees, instructors, contractors, and agents from any claims, damages, liabilities, losses, or expenses, including reasonable attorneys’ fees, arising from:

  • Your violation of these Terms;
  • Your misuse of the Site;
  • Your submission of information you were not legally authorized to provide; or
  • Your violation of any applicable law or the rights of another person.

13. Changes to These Terms

We may revise these Terms from time to time.

When changes are made, we will update the Effective Date at the top of this document.

Your continued use of the Site after the effective date of the revised Terms constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.

Any legal action arising from or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Sacramento County, California.

15. Suspension or Termination

We reserve the right to suspend or terminate your access to the Site or participation in the Academy’s program if:

  • You violate these Terms;
  • Continued participation would interfere with the safe, orderly, or educational operation of the Academy;
  • We are required to do so by law; or
  • We reasonably determine that suspension or termination is necessary to protect the Academy, its students, families, instructors, or staff.

Termination of participation does not relieve you of any outstanding financial obligations owed to the Academy.
